EU Air Passengers’ rights

According to EU legislation an air passenger has to be compensated by the airline in case of cancellation and long delays, even if the passenger does not suffer any loss. There is much case law of the European Court of Justice to this topic. This presentation argues that these cases are no contribution for sustainability. More sustainable means are the steps forseen by an Action Plan of the EU Commission called Sustainable and Smart Mobility Strategy. This Strategy promisses, among many other steps, a ReFuel Aviation (renewable and low carbon fuel), replacement of short distance flights by a network of high speed trains. There are even proposals for contract law: The consumer shall be informed about his ecological footprint when booking and about alternatives for a flight. Intermodality shall be developed.
