Mediation and Tourism Disputes

There is now emerging agreement that deciding travel and tourism-related disputes through judicial processes is less desirable. Alternatives are needed that are better suited to dealing with these high-volume, low-value disputes in a quick, effective, and efficient manner. Given their nature, mediation, arbitration, and hybrid approaches such as med-arb or arb-med-arb, are such alternatives.

In my presentation, I will introduce these alternatives, with a focus on mediation, especially when conducted online. Moreover, I will consider some of the challenges these alternatives pose to policy developers and what approaches there may be to minimise those. This will include a look at some of the work done at the international level, including through the HCCH and the UNWTO.
